1. Acceptance of Terms

These Terms of Service (“Terms”) are a binding agreement between you and CosClub. We may update these Terms from time to time as described in Section 12; continuing to use the site after an update means you accept the revised Terms.

2. Eligibility & Accounts

You must be at least 18 years old, or the age of majority in your state, to create an account or place an order. By using the site, you represent that you meet this requirement.

• You’re responsible for keeping your account credentials confidential and for all activity under your account
• You agree to provide accurate, current information when creating an account or placing an order
• We may suspend or terminate an account we reasonably believe is fraudulent, abusive, or in violation of these Terms

3. Acceptable Use

You agree not to:

• Use the site for any unlawful purpose, or in a way that violates any applicable local, state, or federal law
• Attempt to gain unauthorized access to our systems, other users’ accounts, or non-public areas of the site
• Scrape, harvest, or systematically extract data from the site using automated means
• Resell products purchased at member pricing, or misuse member benefits intended for personal use only
• Interfere with or disrupt the site, its servers, or its security features
• Submit false, misleading, or fraudulent information, including fraudulent payment information

We reserve the right to refuse service, cancel orders, or terminate accounts at our discretion for conduct that violates this section.

4. Orders & Pricing

All orders are subject to acceptance and product availability. We reserve the right to limit quantities, refuse an order, or cancel an order after it’s placed — including in cases of pricing errors, suspected fraud, or stock issues — in which case we’ll notify you and refund any payment already collected.

We make reasonable efforts to display accurate pricing and product information, but errors can occur. If we discover a pricing or listing error on an order you’ve placed, we’ll contact you before shipping to confirm whether you’d like to proceed at the correct price or cancel.

Shipping, returns, and refunds for product orders are governed by our Shipping & Returns policy. Membership billing, renewal, and cancellation are governed by our Membership Terms.

5. Intellectual Property

The CosClub name, logo, site design, graphics, and all text, images, and content we create are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. Product photos and descriptions from brands we carry remain the property of those brands.

You may not copy, reproduce, republish, or create derivative works from any part of the site without our prior written permission, except for personal, non-commercial use in the ordinary course of shopping with us.

6. Third-Party Services

Our site uses third-party services to operate — including payment processing, analytics, and support tools — some of which may place cookies or collect limited technical data as described in our Privacy Policy. We select these providers carefully, but we don’t control their systems and aren’t responsible for their acts or omissions. Any links to third-party websites are provided for convenience; we don’t endorse and aren’t responsible for third-party content or practices.

7. Disclaimers

The site and all products are provided “as is” and “as available.” We don’t guarantee that the site will be uninterrupted, error-free, or secure. Product descriptions, including ingredient and usage information, are provided by us or by the brands we carry in good faith, but we don’t warrant their completeness. Always check product packaging and consult a physician with questions about allergies, sensitivities, or medical conditions before use.

8. Limitation of Liability

To the fullest extent permitted by law, CosClub and its officers, employees, and affiliates won’t be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or our products. Our total liability for any claim relating to your order won’t exceed the amount you paid for that order.

Nothing in these Terms limits liability where the law doesn’t allow it to be limited, including liability for gross negligence, fraud, or personal injury caused by a defective product, which is separately addressed under applicable product liability law.

9. Indemnification

You agree to indemnify and hold CosClub harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the site.

10. Termination

We may suspend or terminate your access to the site or your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to us, other users, or third parties. You may stop using the site at any time.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the site will be resolved in the state or federal courts located in California, and you consent to that jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll update the “Last updated” date at the top of this page. Material changes will be posted here at least 7 days before taking effect. Continued use of the site after changes take effect means you accept the updated Terms.
